Double murderer loses appeal against conviction and sentence

Richard Jory acted for the Crown in the appeal against conviction and sentence of David Baxendale, who had been convicted after trial of the murder of Sarah Thomas in 2010 at Guildford Crown Court. Mr Baxendale argued that the trial judge had misdirected the jury, in particular in directions concerning his previous bad character. The Court heard lengthy submissions before dismissing the appeal against conviction. Similarly, the Court dismissed the appeal against the imposition of a life sentence with a whole life order, indicating that the seriousness of the offending properly fell into the ‘exceptionally high’ category. The defendant had previous convictions for extreme violence, including a previous murder in Spain. He was released from that sentence only 8 months prior to the commission of this new offence. Baxendale is one of about 40 prisoners in the UK serving a life sentence with a whole life tariff and who will never be released.
