Criminal prosecution and defence with an emphasis on serious and complex fraud.

 

During the last ten years, James has often appeared on behalf of HMRC and the SFO. He has particular expertise in the fields of revenue fraud and money laundering. His cases usually have an international element to them. Consequently, James has considerable experience in dealing with cross-jurisdictional issues in relation to the obtaining of evidence and extradition. His cases also involve the restraint and confiscation of assets. He appears in the VAT Tribunal. He is often instructed as a leading junior.

Cases of Interest

R v. Nwaeme (2009). £10 million money laundering prosecution.

R v. Aina and Alo (2008). Prosecution of two Revenue constables for money laundering.

R v. Majid and 19 others (2007-2009). The largest VAT fraud in the court system, this case is ongoing and is being dealt with in several separate trials. James is first junior counsel for the Crown. He was leading counsel in relation to the trial of one of the defendants. He is also sole counsel instructed in the confiscation proceedings.

R v. Corkhill (2003). Multi-million pound VAT fraud, leading for the prosecution.

R v. Johnson and 13 others (2002-2006). First junior counsel for the prosecution in large-scale VAT fraud.

R v. Clark and others (2001-2004). Multi-million pound advance fee fraud. Prosecution by the SFO.

Reported Cases

R v. Spear, 1995 Crim App R (S) 242. This case concerned the criteria to be applied for the imposition of a discretionary life sentence.
